IMPORTANT: Inkwell is not a law firm and cannot provide legal advice. Our employees are not attorneys and are not authorized to practice law. We provide self-help document preparation services under your direction. User Responsibilities

By using our services, you agree to:

Fees and Payment

You agree to pay all fees associated with the services you select. Our fees are separate from government filing fees charged by the USPTO. Key payment terms:

• All fees are in US dollars unless otherwise stated

Refund Policy

We offer a satisfaction guarantee on our service fees. If you are not satisfied with our service within 30 days of purchase, you may request a refund of our service fee. However, please note:

• Government filing fees are non-refundable once submitted to the USPTO
• Refunds are not available after your application has been filed
• Search services are non-refundable once the search has been completed

Intellectual Property

All content on our website, including text, graphics, logos, and software, is the property of Inkwell or its licensors and is protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works without our written permission.

Limitation of Liability

To the maximum extent permitted by law, Inkwell shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability shall not exceed the amount you paid for the services giving rise to the claim.

Disclaimer of Warranties

Our services are provided "as is" without warranties of any kind, either express or implied. We do not guarantee that your trademark application will be approved by the USPTO. The success of your application depends on many factors outside our control, including the strength of your mark and potential conflicts with existing marks.

Indemnification

You agree to indemnify and hold harmless Inkwell, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of our services or violation of these terms.

Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes shall be resolved in the state or federal courts located in Delaware.

Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify you of any changes by posting the new terms on this page. Your continued use of our services after any changes constitutes acceptance of the updated terms.

Severability
